JP Woman Charged with Assault and Battery

Boston Police charged a Jamaica Plain woman with assault and battery in Roslindale after she allegedly forced her way into the apartment of her ex-boyfriend.

On Dec. 27 around 3:34 p.m., Carmen Garcia, of 6 Ernst St. #104, Jamaica Plain, was arrested and charged with assault and battery.

Police were called to the 4070 Washington St., in Roslindale for a disturbance and saw the suspect outside of the address. The suspect told police people were upstairs on the third floor hallway fighting, according to a Boston Police report. Officers went into the building to the third floor and saw three people fighting in the hallway, who the police separated.

Officers spoke with the suspect who said she did not need medical attention, but officers observed "a small amount of what appeared to be blood on the suspect's fingers." The suspect said one of the men was the father of her children, and that she had picked up the children from him earlier in the day, and that she came back to give the man his medicated cream that she found. The suspect said a fight ensued upon arrival and she alleged one of the victim hit her in the face, but police did not see any injuries to the suspect, according to a Boston Police report.

Police spoke with the victim who said the suspect and another person came to the address and were let into the building. But that the suspect allegedly threw something into the apartment and tried to push her way into the place, according to a Boston Police report. 

Officers saw broken glass on the floor of the hallway and several windows were broken.

Police asked the suspect where her children were at present time and she said someone was watching them at a different location. Then she said she was driving a van parked on Fawndale Road. Officers saw the van and saw there were three children in the van as the vehicle was idling with the engine on, according to a Boston Police report.

The children were left under the care of their father, and officers filed a report with Department of Children and Family Services for the three children due to the nature of the incident.
